The real question isn’t whether clemency should exist, but whether one person should wield it with no standards, no appeal, and no review. The pardon power is the only federal authority that can erase a conviction outright, and courts have treated it as nearly absolute since Ex parte Garland in 1866. Presidents have used it for cronies and self-protection: Ford’s Nixon pardon, Bush’s Libby commutation, Trump’s Stone and Flynn commutations, Biden’s Hunter pardon. When the only check is political embarrassment, that’s not accountability, it’s luck.
