The real question isn't whether AI can create lies, but whether the government should decide which tools are allowed in political speech. Banning AI-generated content treats the tool as the crime, when the actual harm is deception—and deception is already illegal. If a campaign runs a deepfake that falsely defames someone, existing defamation and election-fraud laws already apply. What a blanket ban does is sweep up legitimate content, like parody, satire, or a candidate using AI for translation or captioning. The better fix is mandatory disclosure, not prohibition. Voters can handle a clearly labeled AI ad; they can't handle a paternalistic government picking their speech for them.
